Welcome to FanSpot.
These Terms of Service govern your access to and use of FanSpot, including the FanSpot website, creator pages, fan accounts, creator accounts, subscriptions, digital storefronts, posts, comments, messages, tips, purchases, creator tools, account features, and any related services offered by FanSpot.
By accessing FanSpot, creating an account, using the platform, purchasing content, subscribing to a creator, following a creator, applying to become a creator, uploading content, or otherwise using FanSpot, you agree to these Terms.
If you do not agree to these Terms, you may not access or use FanSpot.
1. About FanSpot
FanSpot is a creator monetization platform operated by Martin Pevec acting as FanSpot.
FanSpot allows creators to build creator pages, post content, offer memberships, sell digital products, receive tips, interact with fans, and monetize their fan communities through approved platform features.
FanSpot is designed to support creators such as artists, cosplayers, digital creators, influencers, AI persona creators, visual creators, and other fan-supported creators.
FanSpot is a creator-commerce platform. FanSpot is not intended to be used for illegal activity, stolen content, exploitation, impersonation, harassment, payment abuse, fraud, or unsafe conduct.
2. These Terms Apply to All Users
These Terms apply to all users of FanSpot, including visitors, fans, creators, creator applicants, purchasers, subscribers, users who comment, message, report, or interact with content, and users who submit support requests, disputes, appeals, or complaints.
Additional policies may apply depending on how you use FanSpot, including FanSpot’s Privacy Policy, Creator Agreement, Community Guidelines and Content Policy, AI Creator Policy, Payments/Payouts/Refunds Policy, Copyright Policy, and any other policy posted by FanSpot.
If there is a conflict between these Terms and a more specific FanSpot policy, the more specific policy controls for that issue.
3. Eligibility
You may use FanSpot only if you are legally able to enter into a binding agreement and comply with these Terms.
To create an account or use FanSpot, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, have the legal authority to agree to these Terms, provide accurate account information, not be prohibited from using FanSpot by law, not be previously banned from FanSpot unless FanSpot gives written permission, use FanSpot only for lawful purposes, and comply with all FanSpot policies.
FanSpot may refuse, suspend, restrict, or terminate access if FanSpot believes a user is underage, ineligible, using false information, evading enforcement, or creating legal, safety, payment, or platform-trust risk.
4. Account Registration
To use certain features, you must create an account.
When creating an account, you agree to provide accurate, current, and complete information. You are responsible for keeping your account information updated.
You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account unless the activity was caused by FanSpot’s own security failure.
You must not share your account with another person, sell, rent, transfer, or give away your account, use another person’s account, create an account using false information, create an account for someone else without authorization, create multiple accounts to evade restrictions, use bots, scripts, or automated systems to create accounts, attempt to access FanSpot if you are under the required age, or bypass verification, access controls, paywalls, restrictions, or security systems.
FanSpot may require verification before allowing access to certain features.
5. Fan Accounts
A fan account allows users to follow creators, view permitted content, subscribe to creator pages, purchase digital products, unlock posts, tip creators, comment, bookmark content, and use other fan features offered by FanSpot.
Fans agree not to share paid content outside FanSpot, reupload, leak, copy, resell, scrape, distribute, or exploit creator content, harass, threaten, stalk, blackmail, pressure, exploit, or abuse creators or other users, request illegal, non-consensual, exploitative, stolen, or prohibited content, use chargebacks, refunds, disputes, or reports abusively, circumvent paywalls, restrictions, or technical protections, misrepresent identity, age, payment authorization, or account ownership, use FanSpot to conduct scams, fraud, or off-platform payment evasion, or interfere with a creator’s safety, privacy, business, or account.
FanSpot may restrict fan accounts that violate these Terms.
6. Creator Accounts
A creator account allows approved creators to build creator pages, post content, offer subscriptions, sell digital products, receive tips, and use creator monetization tools.
Approval as a creator is not automatic. FanSpot may approve, reject, restrict, suspend, or remove creator access at its discretion.
Creators agree that they are at least 18 years old or the age of majority in their jurisdiction, whichever is higher, they own or have all required rights to upload, publish, sell, and monetize their content, they will not upload stolen, illegal, non-consensual, exploitative, misleading, or prohibited content, they will provide accurate application, verification, payout, and tax information, they will comply with FanSpot’s Creator Agreement and all creator policies, they will not manipulate sales, engagement, subscribers, creator tiers, payouts, or platform systems, they will not mislead fans about content, pricing, subscriptions, store products, delivery, identity, or benefits, and they will cooperate with FanSpot during reviews, reports, disputes, chargebacks, verification checks, or investigations.
FanSpot may require creators to complete identity verification, tax setup, payout setup, manual review, and other compliance steps before monetization or payout access is enabled.
7. Creator Verification
FanSpot may require creators to complete verification before accessing creator features, paid features, or payouts.
Verification may include legal name, date of birth, government-issued ID, selfie or liveness check, tax information, banking or payout information, content ownership confirmation, manual review, and additional checks required by FanSpot or payment partners.
FanSpot may restrict, suspend, or deny creator access if verification is incomplete, false, inconsistent, suspicious, expired, or failed.
FanSpot may hold payouts while verification is pending.
8. Platform Rules Summary
FanSpot is built around creator freedom, fan engagement, and platform trust.
Users must not use FanSpot to break the law, upload stolen content, violate intellectual-property rights, impersonate another person, mislead users, commit fraud, abuse payments, refunds, or chargebacks, harass or threaten others, share another person’s private information without permission, upload exploitative, abusive, or unsafe content, evade account restrictions, bypass paywalls or security systems, use bots, fake engagement, fake fans, or manipulation, or harm FanSpot, creators, fans, payment partners, or platform trust.
FanSpot may take action against accounts, content, payments, payouts, subscriptions, purchases, or creator features that violate these Terms.
9. User Conduct Rules
You agree not to violate any law or regulation, violate these Terms or any FanSpot policy, upload, post, sell, message, or promote prohibited content, misrepresent your identity, age, location, ownership rights, AI status, or creator status, use FanSpot to harass, abuse, threaten, intimidate, stalk, exploit, or manipulate another person, use FanSpot for scams, fraud, stolen payment methods, fake purchases, or payment manipulation, upload malware, phishing links, spyware, viruses, or harmful code, scrape, crawl, copy, archive, reverse engineer, or misuse FanSpot systems, circumvent paywalls, access restrictions, watermarks, age gates, security tools, or moderation systems, share, leak, resell, or redistribute paid content, submit false reports, false chargebacks, false copyright claims, or false verification information, create accounts to evade enforcement, interfere with FanSpot’s operation, or encourage another person to violate these Terms.
FanSpot may determine, in its reasonable judgment, whether conduct violates these Terms.
10. Content Ownership
You retain ownership of content you own and upload to FanSpot.
By uploading, posting, messaging, selling, listing, or otherwise making content available on FanSpot, you grant FanSpot a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, display, reproduce, distribute, transmit, format, promote, analyze, moderate, and make your content available as needed to operate, improve, protect, enforce, and market FanSpot.
This license allows FanSpot to display creator pages and posts, deliver content to authorized fans, process purchases and subscriptions, operate creator storefronts, show previews where permitted, moderate content, investigate reports, maintain backups and logs, enforce platform rules, comply with legal obligations, and promote FanSpot or creators where permitted.
You represent that you have all rights needed to grant this license.
11. Paid Content and Access Rights
When a fan purchases, subscribes to, unlocks, tips for, or otherwise pays for content, the fan receives only a limited, personal, non-transferable, non-exclusive, revocable right to access that content through FanSpot.
A purchase does not transfer ownership of content to the fan.
Fans may not reupload paid content, share paid content with others, sell, trade, leak, or redistribute paid content, use paid content commercially, remove watermarks or access controls, use tools to bypass restrictions, or copy, scrape, screen record, or archive paid content unless FanSpot expressly permits downloading.
FanSpot may remove or restrict access to content if required for legal, safety, policy, payment, creator-rights, or platform-integrity reasons.
12. Purchases
FanSpot may allow users to purchase subscriptions, locked posts, digital products, store items, tips, paid messages, or other approved features.
By making a purchase, you agree that you are authorized to use the payment method, you understand what you are buying, prices, taxes, fees, and currency may vary, some purchases may be final once access is granted, refunds are governed by FanSpot’s refund rules, FanSpot may review, reject, cancel, reverse, or restrict transactions for fraud, safety, legal, payment, or policy reasons, FanSpot may use third-party payment processors, payment processors may have their own terms, you will not abuse refunds, disputes, or chargebacks, and FanSpot may restrict purchases for users who create payment risk.
13. Subscriptions
Creators may offer subscription tiers with different benefits.
Unless otherwise stated, subscriptions renew automatically until cancelled, subscription prices and benefits are shown before purchase, fans may cancel future renewals through their billing settings, cancelling a subscription stops future billing but does not always create a refund for the current period, creator benefits may change over time, FanSpot may cancel, pause, or restrict subscriptions if a creator account is suspended, inactive, removed, or unable to provide benefits, and FanSpot may restrict subscriptions for legal, payment, fraud, safety, or policy reasons.
Creators must not mislead fans about subscription benefits, posting frequency, exclusive content, pricing, renewals, or refund eligibility.
14. Tips and One-Time Support
Fans may use tips or one-time support features to support creators.
A tip does not guarantee specific content, services, personal attention, messages, future posts, or special treatment unless FanSpot and the creator clearly state otherwise.
Tips may be subject to fees, taxes, fraud review, chargeback review, payout delays, refund rules, and processor restrictions.
FanSpot may review, hold, reverse, or restrict tips if there is suspected fraud, payment abuse, policy violation, or platform risk.
15. Digital Storefronts
Creators may sell approved digital products through FanSpot storefronts.
Digital products may include approved downloadable files, art, templates, digital packs, written materials, creator-made digital items, or other permitted digital goods.
Creators are responsible for accurate listings, descriptions, prices, files, delivery terms, rights, permissions, and support.
Fans are responsible for reviewing product details before purchase.
FanSpot may remove, restrict, refund, or review listings that are misleading, infringing, prohibited, fraudulent, unsafe, or inconsistent with platform rules.
16. Custom Orders and Commissions
If FanSpot enables commissions or custom orders, creators must clearly state what is included, what is not included, price, delivery estimate, revision limits if any, whether approval is required, whether the product is digital only, usage rights granted to the buyer, and any important restrictions.
Users may not request, accept, sell, or deliver prohibited custom content.
FanSpot may cancel, refund, restrict, or remove custom orders that violate platform rules.
17. Messages and Comments
FanSpot may allow users to comment, message, or communicate through platform features.
Users must not use comments or messages to harass, threaten, exploit, pressure, or abuse another person, request prohibited content, send spam, scams, phishing links, malware, or deceptive offers, bypass FanSpot payments, fees, policies, or restrictions, share paid content illegally, impersonate another person, violate privacy or intellectual-property rights, or evade moderation.
FanSpot may review, restrict, preserve, or remove messages and comments where needed for support, moderation, safety, fraud prevention, legal compliance, payment disputes, or enforcement.
18. Adult-Content Access Summary
FanSpot may include age-restricted or adult-content features only if those features are active, approved by FanSpot, supported by FanSpot’s payment partners, and operated under FanSpot’s applicable adult-content rules.
Adult-content access is not guaranteed. FanSpot may disable, delay, limit, restrict, or remove adult-content access at any time.
Users may not access age-restricted content unless they are at least 18 years old or the age of majority in their jurisdiction, whichever is higher, are legally allowed to access that content in their location, have completed any required account, age, payment, or identity checks, have enabled any required age-restricted access setting, agree to all applicable adult-content rules, and comply with FanSpot’s content, payment, and safety policies.
FanSpot may hide age-restricted content from general discovery, search, recommendations, homepage areas, public previews, and users who have not enabled eligible access.
FanSpot has zero tolerance for content or conduct involving minors, exploitation, coercion, trafficking, non-consensual material, stolen intimate content, impersonation-based intimate content, or any illegal sexual content.
FanSpot may immediately remove content, restrict accounts, preserve records, freeze payouts, terminate accounts, and report suspected illegal activity where required or appropriate.
Creators may not post or monetize adult content unless FanSpot has approved them for that category and all required verification, consent, payment, moderation, and record requirements are satisfied.
19. AI-Content Summary
FanSpot may allow AI creators, AI personas, AI-assisted content, and synthetic content where permitted by FanSpot’s AI Creator Policy.
AI creators must clearly disclose AI status where required.
Users must not use AI to impersonate real people, mislead fans into believing an AI persona is a real person where that is not true, use another person’s name, image, likeness, voice, identity, or recognizable traits without permission, create non-consensual intimate or adult material involving real people, create prohibited sexual, exploitative, or unsafe material, evade moderation, verification, copyright, consent, or platform rules, or misrepresent AI-generated content as verified real-person content.
FanSpot may label, restrict, remove, demonetize, or ban AI content that violates platform rules or creates legal, safety, consent, intellectual-property, or trust risk.
20. Prohibited Content
Users may not upload, post, sell, message, request, link to, promote, or distribute prohibited content.
Prohibited content includes illegal content, stolen content, non-consensual content, content involving minors in prohibited contexts, exploitative, coercive, or abusive content, impersonation, copyright or trademark infringement, scams, fraud, fake giveaways, or deceptive listings, harassment, threats, stalking, doxxing, blackmail, or intimidation, hate, dehumanization, or targeted abuse, terrorism, violent extremism, or organized criminal activity, malware, phishing, spyware, or harmful code, spam, fake engagement, bots, or platform manipulation, content designed to evade moderation, access controls, payment rules, or legal requirements, and any content FanSpot determines creates unacceptable legal, safety, payment, reputational, operational, or platform-trust risk.
FanSpot may update prohibited-content rules at any time.
21. Reporting
Users may report content, accounts, messages, listings, purchases, creators, or conduct that they believe violates FanSpot rules.
Reports may involve illegal content, stolen content, impersonation, harassment, payment fraud, scams, misleading listings, prohibited content, copyright violations, consent concerns, safety concerns, and platform abuse.
FanSpot may review reports manually, automatically, or through a combination of both.
FanSpot may prioritize reports based on severity, safety risk, legal risk, payment risk, and platform impact.
22. Appeals
Users may be allowed to appeal certain enforcement decisions.
An appeal should include the account involved, the content or action being appealed, the reason the user believes the decision was incorrect, and supporting information or documents if applicable.
FanSpot may accept, deny, partially grant, or close an appeal.
Some decisions may be final, especially decisions involving serious safety, fraud, exploitation, payment, legal, verification, or platform-trust concerns.
23. Moderation and Enforcement
FanSpot may moderate content, accounts, messages, listings, purchases, subscriptions, payouts, and platform activity.
FanSpot may take enforcement action including no action, warning, content removal, content relabeling, reduced visibility, comment restriction, message restriction, purchase restriction, subscription cancellation, store restriction, creator feature restriction, account review, temporary suspension, payout hold, payout reserve, account termination, permanent ban, legal escalation, and report to appropriate authorities where required or appropriate.
FanSpot is not required to disclose all details of moderation decisions, especially where disclosure may compromise safety, privacy, investigations, payment systems, platform integrity, or legal compliance.
24. Account Suspension and Termination
FanSpot may suspend, restrict, or terminate an account at any time if FanSpot believes the user has violated these Terms, violated platform policies, created risk, failed verification, engaged in suspicious activity, or harmed FanSpot, creators, fans, payment systems, or platform trust.
FanSpot may act without prior notice where necessary.
Reasons for suspension or termination may include underage use, false information, failed verification, fraud, chargeback abuse, harassment, illegal activity, prohibited content, copyright infringement, impersonation, stolen content, payment abuse, fake engagement, security abuse, attempted ban evasion, adult-content rule violations, AI-content rule violations, or any conduct FanSpot determines creates serious platform risk.
After suspension or termination, you may lose access to your account, you may lose access to content, creator pages may be hidden, subscriptions may be cancelled, purchases may be restricted, messages may be restricted, payouts may be held, offset, delayed, or forfeited where allowed by policy, FanSpot may preserve records where needed for legal, safety, payment, fraud-prevention, tax, compliance, or enforcement purposes, and you may not create a new account without FanSpot’s permission.
25. Inactive Accounts
FanSpot may treat an account as inactive if it has not been used for a period determined by FanSpot.
FanSpot may limit, hide, pause, archive, or close inactive accounts where allowed.
Creator monetization, discovery visibility, storefronts, subscriptions, and payouts may be paused if a creator becomes inactive, fails verification, or fails to meet platform activity requirements.
26. Payments, Fees, and Taxes
FanSpot may charge platform fees, transaction fees, payout fees, subscription fees, product fees, or other fees disclosed through the platform or applicable policies.
Payment processors may also charge fees.
Creators are responsible for their own taxes, income reporting, and financial obligations unless FanSpot expressly states otherwise.
FanSpot may collect tax information, issue tax forms, withhold payouts, or report payments where required.
FanSpot may change fees by updating the platform or applicable policies.
27. Refunds and Chargebacks
Refunds are governed by FanSpot’s refund rules and applicable law.
FanSpot may consider refunds for unauthorized transactions, duplicate charges, platform errors, technical failures that prevent access, failure to deliver a purchased digital product, misleading listings, fraud, serious creator misconduct, or other cases FanSpot determines appropriate.
Refunds are not guaranteed for buyer regret, forgetting to cancel a subscription, not liking content after access is granted, creator posting changes unless required by policy, account suspension caused by the fan’s own violation, off-platform arrangements, or attempts to bypass FanSpot rules.
Users should contact FanSpot before filing a chargeback where possible.
FanSpot may restrict or ban users who submit false, abusive, excessive, or bad-faith chargebacks.
FanSpot may hold creator payouts during refund, dispute, fraud, or chargeback review.
28. Payouts
Creators may receive payouts only after completing required verification, tax, banking, payout, and compliance steps.
FanSpot may delay, hold, reduce, offset, or freeze payouts for reasons including chargebacks, refunds, fraud concerns, suspicious transactions, failed verification, missing tax information, processor holds, policy violations, content reports, legal requests, account reviews, consent disputes, stolen content claims, abnormal sales activity, required reserves, or any platform-risk concern.
FanSpot may deduct refunds, chargebacks, processor fees, taxes, penalties, dispute costs, or other amounts owed from creator balances where permitted.
29. Creator Tiers and Platform Benefits
FanSpot may offer creator tiers, badges, feature access, payout speeds, discovery benefits, upload limits, analytics, storefront tools, and other benefits.
Creator tier status may depend on account age, revenue, followers, paying fans, active fans, compliance history, chargeback rate, content quality, posting consistency, manual review, fraud risk, and platform trust.
FanSpot may change, pause, revoke, or manually review tier status at any time.
Creators must not manipulate tiers through fake purchases, fake fans, self-purchases, artificial engagement, refund schemes, or coordinated activity.
30. Discovery and Promotion
FanSpot may display creators and content through search, discovery pages, categories, featured sections, recommendations, trending areas, badges, and promotional tools.
FanSpot does not guarantee visibility, subscribers, followers, traffic, sales, ranking, placement, or income.
FanSpot may reduce or remove discovery visibility for policy violations, inactivity, mislabeling, low trust signals, chargeback risk, spam, poor fan experience, fraud concerns, legal risk, payment-processor concerns, manual review, and age-restricted status where applicable.
31. Copyright and Intellectual Property
FanSpot respects intellectual-property rights.
Users must not upload, sell, share, or distribute content they do not own or have permission to use.
FanSpot’s name, brand, logo, platform design, interface, software, code, features, graphics, and systems are owned by FanSpot or its licensors.
Users may not copy, modify, distribute, imitate, reverse engineer, sell, exploit, or misuse FanSpot intellectual property without written permission.
FanSpot may remove content or restrict accounts that infringe intellectual-property rights.
Repeat infringers may be terminated.
32. Privacy
FanSpot’s collection, use, storage, sharing, and protection of personal information is governed by FanSpot’s Privacy Policy.
By using FanSpot, you agree to the Privacy Policy.
FanSpot may collect and process information needed to operate the platform, including account information, content, purchases, subscriptions, payment-related information, creator verification information, payout information, tax information, reports, messages, support requests, device information, and security logs.
Sensitive information may be handled by third-party processors where appropriate.
33. Third-Party Services
FanSpot may use third-party services, including payment processors, payout providers, identity-verification providers, tax tools, hosting providers, analytics tools, email providers, storage providers, security tools, moderation tools, and support tools.
Third-party services may have their own terms and privacy policies.
FanSpot is not responsible for third-party services except where required by law.
FanSpot may change third-party providers at any time.
34. Platform Availability
FanSpot may change, suspend, remove, limit, or discontinue any feature at any time.
FanSpot does not guarantee continuous availability, error-free operation, permanent access to content, permanent access to features, creator earnings, fan purchases, subscriber growth, search placement, payment approval, payout timing, or compatibility with every device or browser.
FanSpot may perform maintenance, upgrades, security work, emergency changes, compliance reviews, payment changes, or feature removals without liability where permitted.
35. Beta and Early Features
FanSpot may release beta, test, experimental, or early-access features.
Beta features may be incomplete, unstable, limited, changed, removed, or restricted at any time.
Users should not rely on beta features for critical business activity unless FanSpot expressly states otherwise.
36. No Guarantee of Earnings
FanSpot does not guarantee that creators will earn money, receive subscribers, sell products, gain followers, get promoted, grow an audience, or succeed financially.
Creator results depend on many factors outside FanSpot’s control, including content quality, audience loyalty, pricing, posting frequency, marketing, fan demand, platform rules, payment approval, refund rates, chargebacks, and creator conduct.
37. Disclaimers
FanSpot is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, FanSpot disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.
FanSpot does not guarantee that the platform will always be available, content will always remain accessible, users will comply with these Terms, creators will deliver expected content, fans will make purchases, payment processors will approve transactions, payouts will occur on a particular timeline, moderation will catch every violation, third-party services will remain available, or FanSpot will meet every user expectation.
38. Limitation of Liability
To the maximum extent permitted by law, FanSpot, Martin Pevec acting as FanSpot, and FanSpot’s contractors, service providers, representatives, partners, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages for lost profits, lost revenue, lost data, lost content, lost followers, lost subscribers, lost business opportunities, account restrictions, content removal, payment delays, payout holds, chargebacks, refunds, platform downtime, third-party service failures, unauthorized access, and user misconduct.
To the maximum extent permitted by law, FanSpot’s total liability for any claim relating to the platform will not exceed the greater of the amount you paid to FanSpot in the three months before the claim arose or $100 CAD.
Some jurisdictions do not allow certain limitations, so some limitations may not apply.
39. Indemnity
You agree to defend, indemnify, and hold harmless FanSpot, Martin Pevec acting as FanSpot, and FanSpot’s contractors, service providers, representatives, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising from your use of FanSpot, your content, your violation of these Terms, your violation of law, your violation of another person’s rights, your payment activity, your tax obligations, your creator sales or services, your failure to obtain required rights or consent, your intellectual-property infringement, your fraud, chargebacks, disputes, or suspicious activity, your misuse of FanSpot systems, or your violation of adult-content or AI-content rules.
FanSpot may control the defense of any claim at your expense where appropriate.
40. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
You agree that disputes relating to these Terms or FanSpot will be handled in the courts located in Ontario, Canada, unless applicable law requires otherwise or FanSpot chooses another legally available forum.
41. Dispute Resolution
Before filing a legal claim, you agree to contact FanSpot and attempt to resolve the dispute informally.
Your notice should include your name, your account information, a description of the issue, the relief requested, and relevant documents or screenshots.
FanSpot may respond within a reasonable period.
Nothing in this section prevents FanSpot from seeking urgent legal relief for security threats, fraud, intellectual-property violations, harassment, abuse, exploitation, payment abuse, platform manipulation, or other serious harm.
42. Changes to These Terms
FanSpot may update these Terms from time to time.
FanSpot may notify users by posting updated Terms, updating the “Last Updated” date, sending an email, showing an in-platform notice, or using another reasonable method.
Continued use of FanSpot after updated Terms become effective means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using FanSpot.
43. Assignment
You may not assign or transfer your rights or obligations under these Terms without FanSpot’s written permission.
FanSpot may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, financing, change of control, or business transfer.
44. Severability
If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect.
The invalid or unenforceable part will be modified to the minimum extent necessary to make it valid and enforceable, if possible.
45. No Waiver
FanSpot’s failure to enforce any part of these Terms does not waive FanSpot’s right to enforce that part later.
Any waiver must be in writing and signed by FanSpot.
46. Entire Agreement
These Terms, together with the FanSpot policies and agreements referenced in them, form the entire agreement between you and FanSpot regarding your use of the platform.
