This AI Creator Policy governs AI creators, AI-generated content, AI-assisted content, synthetic personas, AI disclosure, AI badges, real-person likeness restrictions, AI impersonation rules, AI messaging disclosures, AI adult-content limits, and related creator obligations on FanSpot.
This Policy is part of the FanSpot Terms of Service and Creator Agreement.
By creating an AI creator account, uploading AI-generated content, using AI-assisted media, operating an AI persona, selling AI content, messaging fans through an AI persona, or otherwise using FanSpot as an AI creator, you agree to this Policy.
1. Purpose of This Policy
FanSpot allows AI creators because AI personas, synthetic characters, fictional creators, and AI-assisted visual content can be legitimate creator categories when they are honest, original, properly labeled, and not used to deceive or harm users.
The purpose of this Policy is to allow original AI creators on FanSpot, require clear AI disclosure, prevent impersonation, prevent misleading creator identities, protect real people from unauthorized likeness use, protect fans from deception, protect creators from stolen AI work, prevent non-consensual AI content, prevent prohibited adult AI content, and keep AI creator pages clearly labeled and trustworthy.
FanSpot supports AI creativity, but AI may not be used to evade consent, identity, content, payment, age, copyright, moderation, or safety rules.
2. Relationship to Other FanSpot Policies
This Policy works together with FanSpot Terms of Service, FanSpot Privacy Policy, FanSpot Creator Agreement, FanSpot Community Guidelines and Content Policy, FanSpot Adult Content, Age Verification and Consent Policy if applicable, FanSpot Payments, Payouts, Refunds and Chargebacks Policy, FanSpot Copyright / DMCA / IP Policy, and any additional creator, content, verification, payout, or safety rules posted by FanSpot.
If this Policy conflicts with another FanSpot policy, the stricter rule applies where AI identity, consent, likeness, adult content, user safety, or platform trust is involved.
3. Definitions
For this Policy:
“FanSpot” means FanSpot, operated by Martin Pevec acting as FanSpot.
“AI Creator” means a creator account that uses an AI-generated persona, AI-assisted identity, synthetic character, fictional digital model, AI-generated imagery, AI-assisted media, or AI-operated creator brand.
“AI Content” means content created, generated, edited, enhanced, modified, animated, written, voiced, or materially assisted by artificial intelligence tools.
“AI-Assisted Content” means content that includes meaningful AI involvement, even if some parts were created manually.
“Synthetic Persona” means a fictional or artificial creator identity that is not a real human public persona.
“Real-Person Likeness” means a person’s face, body, voice, name, username, stage name, identity, image, recognizable traits, personal style, personal branding, or other identifying features.
“Impersonation” means presenting or implying that an AI account, persona, image, voice, message, or content is a real person, public figure, creator, celebrity, influencer, private person, brand representative, or another user without authorization.
“AI Disclosure” means a clear statement or label showing that a creator, persona, content, image, voice, message, or account is AI-generated, AI-assisted, synthetic, fictional, or operated as an AI persona.
4. AI Creators Are Allowed Only With Transparency
FanSpot may allow AI creators if they are transparent, original, properly labeled, and compliant with FanSpot policies.
AI creators must not mislead users into believing that an AI persona is a real human creator.
AI creators must clearly disclose AI status in required areas, which may include creator application, creator profile, creator bio, creator category, creator badge, content labels, store listings, subscription descriptions, paid messages, fan-facing creator identity areas, and any other location required by FanSpot.
FanSpot may require AI creators to use an AI badge, AI label, AI category, or other disclosure marker.
5. AI Creator Disclosure Form
FanSpot may require AI creators to complete an AI Creator Disclosure Form before approval or monetization.
The disclosure may require creator legal name, creator account username, AI persona name, confirmation that the persona is AI-generated, synthetic, fictional, or AI-assisted, description of the AI persona, content categories planned, whether the account uses AI-generated images, video, voice, text, AI chat, or automated messaging, whether the content is based on any real person, whether any real-person likeness, voice, or identity is used, whether permissions or releases exist for any real-person likeness, whether the AI persona is intended for general or age-restricted content, confirmation that the account will not impersonate a real person, and confirmation that the creator will follow FanSpot’s AI rules.
FanSpot may deny or restrict AI creator approval if the disclosure is incomplete, false, misleading, suspicious, or inconsistent with platform rules.
6. AI Badge Rules
FanSpot may assign an AI badge to AI creator accounts.
The AI badge may appear on creator profile pages, creator cards, discovery results, search results, store listings, paid posts, subscription pages, messaging areas, fan-facing account areas, and any other area FanSpot chooses.
AI creators must not hide, remove, misrepresent, cover, or obscure AI badges.
FanSpot may require an AI badge even if the creator believes the AI nature is obvious.
A badge may be changed, redesigned, renamed, removed, or replaced by FanSpot at any time.
7. AI Category and Profile Requirements
AI creator profiles must be honest and clear.
An AI creator profile must not claim the AI persona is a real human if it is not, claim the AI persona personally performs real-world actions if it does not, claim the AI persona has a legal identity, real body, real location, real job, real agency, or real-life history if those claims are false or misleading, mislead fans into believing they are interacting with a verified real person, use a real person’s name, image, voice, or identity without permission, use another creator’s branding, style, or identity in a confusing way, or hide material AI use where FanSpot requires disclosure.
AI creators may use fictional biographies, fictional worldbuilding, character lore, and creative branding if the AI nature of the account is still clear.
8. Real-Person Likeness Restrictions
AI creators must not use a real person’s likeness without valid permission.
This includes using, generating, editing, recreating, copying, or strongly imitating a real person’s face, body, distinctive physical identity, voice, legal name, stage name, username, personal brand, photos, videos, recognizable style, or identity in a way likely to confuse users.
This applies to public figures, celebrities, influencers, creators, private people, and FanSpot users.
If an AI creator uses a real-person likeness with permission, FanSpot may require proof of consent, a release form, identity verification, and additional review.
FanSpot may remove or restrict content that appears to use a real-person likeness without permission.
9. Impersonation Rules
AI may not be used for impersonation.
Users must not use AI to pretend to be another person, pretend to be a celebrity, influencer, creator, public figure, private person, brand, company, or FanSpot representative, mislead fans into believing a real person owns, operates, appears in, endorses, or approves an AI account, create fake statements, fake endorsements, fake messages, fake images, fake videos, or fake voice content from another person, copy another creator’s identity or brand in a confusing way, use another person’s likeness for paid content without permission, or create AI content designed to deceive, manipulate, or defraud.
FanSpot may remove content, require edits, add labels, restrict discovery, freeze payouts, suspend accounts, or terminate accounts for impersonation.
10. No Non-Consensual AI Content
AI must not be used to create, upload, sell, promote, message, or distribute non-consensual content.
This includes AI content using a real person’s image without permission, AI content using a real person’s voice without permission, AI intimate or adult content involving a real person without valid consent, AI content designed to embarrass, threaten, harass, exploit, blackmail, or humiliate another person, AI content made from stolen photos, leaked content, private images, or unauthorized recordings, and AI content that falsely presents a real person as saying, doing, endorsing, or participating in something they did not authorize.
FanSpot may immediately remove non-consensual AI content and restrict or terminate accounts involved.
11. AI Content Involving Minors Is Strictly Prohibited in Adult Contexts
AI may not be used to create, upload, sell, promote, request, message, or distribute content involving minors in adult, exploitative, suggestive, unsafe, or age-restricted contexts.
This prohibition applies to real minors, fictional minors, AI-generated minors, illustrated minors, synthetic minors, youth-coded characters, characters presented as underage, characters whose age is ambiguous in a restricted context, and roleplay, captions, descriptions, tags, prompts, or messages implying underage participation in restricted content.
FanSpot may immediately remove content, restrict accounts, preserve records, terminate accounts, and report suspected illegal activity where required or appropriate.
12. AI Adult-Content Limits
AI creators may not upload, sell, promote, message, or monetize adult AI content unless FanSpot has activated adult-content features, the creator is approved for adult-content categories, the creator is approved as an AI creator, the content is properly labeled as AI where required, the content is properly labeled as age-restricted where required, the content does not use a real-person likeness without valid permission, the content does not involve minors or youth-coded characters, the content does not involve non-consent, coercion, exploitation, impersonation, stolen material, or prohibited categories, the content complies with FanSpot’s Adult Content, Age Verification and Consent Policy, and the content complies with payment-processor requirements.
FanSpot may deny, restrict, remove, demonetize, suppress, or ban AI adult content at any time.
13. AI Messaging Disclosure Rules
If an AI creator uses automated messaging, AI-generated replies, AI chat tools, scripted persona replies, or AI-assisted fan communication, the creator must disclose AI involvement where FanSpot requires it.
AI creator messaging must not mislead fans into believing they are speaking to a real human creator if they are not, pretend that an AI persona personally knows the fan outside what the platform allows, manipulate fans into purchases through deception, pressure fans with false claims, pretend to have real emotions, real memories, real physical presence, or real personal relationships in a misleading way, request prohibited content, send prohibited content, evade age restrictions, evade payment rules, evade moderation, harass, threaten, exploit, or manipulate users, or share private user information.
FanSpot may restrict AI messaging, require additional labels, review messages, limit automation, or remove messaging access for violations.
14. AI and Fan Trust
AI creators must treat fans honestly.
AI creators must not mislead fans about who or what they are supporting, pretend an AI persona is a verified real person, promise real-world interaction that cannot be delivered, claim a fan has a special real-world relationship with an AI persona in a misleading way, use fake scarcity, fake emergencies, fake personal hardship, or fake emotional pressure to drive purchases, present fabricated personal details as real where doing so would deceive fans, use AI to manipulate vulnerable users, or use AI to fake engagement, reviews, comments, purchases, or fan activity.
FanSpot may restrict creator tools where an AI account damages fan trust.
15. AI Content Ownership and Rights
AI creators are responsible for ensuring they have the rights required to upload, sell, promote, and monetize AI content.
Creators must ensure that AI content does not violate copyright rights, trademark rights, privacy rights, publicity rights, contract rights, platform rules, real-person likeness rights, consent requirements, generator/tool terms where applicable, payment-processor rules, or applicable law.
FanSpot may require proof of rights, licenses, permissions, releases, or generation history where needed.
FanSpot may remove AI content that appears stolen, infringing, unauthorized, or high-risk.
16. AI-Generated Voice Rules
AI-generated or AI-cloned voices may not be used to impersonate real people.
Creators must not use AI voice tools to imitate a celebrity, influencer, creator, private person, FanSpot user, public figure, brand representative, or real person who has not provided permission.
FanSpot may require disclosure for AI-generated voice content.
FanSpot may remove voice content that is misleading, impersonating, non-consensual, or harmful.
17. AI-Generated Video and Image Rules
AI-generated images or videos must comply with this Policy.
Creators must not upload AI images or videos that use a real person’s likeness without permission, impersonate another creator, mislead fans about whether the person exists, use stolen photos or videos as source material without rights, create non-consensual intimate material, create prohibited minor-related content, violate copyright, trademark, privacy, publicity, or platform rules, evade adult-content restrictions, or evade AI disclosure requirements.
FanSpot may require labels, remove content, suppress discovery, hold payouts, or restrict accounts.
18. AI Creator Store Rules
AI creators may sell approved digital products through FanSpot storefronts if they meet FanSpot’s creator, store, and content rules.
AI creator store listings must disclose AI involvement where required.
AI creators must not sell AI content that infringes rights, AI content using real-person likenesses without permission, AI content that impersonates another person, AI adult content unless approved under FanSpot rules, AI content involving prohibited minor-related material, AI content made from stolen images, leaked content, or unauthorized source material, AI products that mislead buyers, AI tools or files designed for harassment, exploitation, impersonation, evasion, fraud, or abuse, or AI content that violates FanSpot payment, content, or safety policies.
FanSpot may remove AI store listings and issue refunds where appropriate.
19. AI Creator Subscription Rules
AI creators may offer subscriptions if approved by FanSpot.
Subscription pages must not mislead fans about the nature of the creator.
If subscription benefits include AI-generated content, AI-assisted messages, AI images, AI storylines, AI personas, AI voice, or AI interaction, FanSpot may require clear disclosure.
Creators must not sell subscriptions by pretending the AI persona is a real verified human creator.
20. AI Custom Orders and Commissions
If FanSpot enables custom orders or commissions, AI creators may accept approved AI-related custom requests.
AI creators must reject custom requests that involve real-person likeness use without permission, impersonation, non-consensual intimate content, prohibited minor-related content, harassment, threats, blackmail, abuse, copyright infringement, stolen source material, adult content outside approved categories, evasion of FanSpot rules, or any prohibited content category.
FanSpot may cancel, refund, restrict, or review AI custom orders that create legal, safety, payment, or platform-trust risk.
21. AI Creator Advertising and Promotion
AI creators may promote their FanSpot pages, but promotion must be honest.
AI creators must not claim to be a real person if they are not, claim false endorsements, use real-person likenesses without permission, use misleading screenshots or fake messages, hide AI status where disclosure is required, promote prohibited adult content, promote content to ineligible users, use stolen images or branding, imply FanSpot has verified something FanSpot has not verified, or misrepresent badge status, tier status, or creator approval.
FanSpot may restrict creator promotion, discovery, or account access for misleading AI marketing.
22. AI Discovery and Labeling
FanSpot may display AI creators in AI categories, general categories, search, discovery, recommendations, creator cards, and profile areas where appropriate.
FanSpot may also restrict or suppress AI creators from certain areas if needed for transparency, fan trust, adult-content controls, age restrictions, payment rules, platform quality, impersonation concerns, user safety, legal risk, or misleading presentation.
FanSpot may require AI creators to appear with labels or badges in discovery areas.
23. AI Creator Verification
FanSpot may require AI creators to complete creator verification even if the persona itself is fictional or synthetic.
The human or business operating the AI creator account may be required to provide legal name, date of birth, government-issued identification, selfie or liveness check, tax information, payout information, ownership information, AI disclosure information, permission documentation where real-person likeness is used, and any other information FanSpot requires.
AI creator accounts may not be used to avoid creator verification.
Payout eligibility remains tied to the verified operator behind the AI account.
24. AI Creator Compliance Duties
AI creators must keep AI disclosure accurate, update AI disclosures if their content changes, use required AI labels, respect real-person likeness rules, avoid impersonation, avoid misleading fans, follow adult-content limits, follow messaging disclosure rules, maintain ownership or permission records, cooperate with FanSpot reviews, remove non-compliant content when requested, respond to reports or disputes, and follow all FanSpot policies.
FanSpot may require AI creators to update profile language, badges, labels, listings, messages, or content to improve transparency.
25. AI Creator Review
FanSpot may review AI creator accounts before or after approval.
Review may include AI disclosure review, profile review, persona review, content review, store listing review, messaging review, adult-content review if applicable, real-person likeness review, impersonation review, fan complaint review, payment-risk review, manual review, and platform-trust review.
FanSpot may require changes before allowing monetization or discovery.
26. Reports Involving AI Content
Users may report AI creators or AI content for missing AI disclosure, impersonation, real-person likeness misuse, misleading identity, non-consensual content, prohibited adult content, prohibited minor-related content, copyright infringement, stolen source material, scam activity, misleading subscriptions, misleading store listings, harmful messaging, or other policy violations.
Reports may be submitted through FanSpot’s reporting tools or by emailing legal@fanspot.me.
27. Takedowns and Restrictions
FanSpot may remove, restrict, demonetize, suppress, relabel, or review AI content if FanSpot determines that the content violates this Policy or creates risk.
FanSpot may take action including adding an AI label, requiring disclosure edits, removing content, removing store listings, restricting messages, restricting subscriptions, suppressing discovery, holding payouts, requiring proof of permission, requiring creator re-verification, suspending the account, terminating the account, preserving records, and reporting suspected illegal activity where required or appropriate.
28. Payout Holds for AI Policy Review
FanSpot may hold, delay, reserve, reduce, offset, or freeze payouts if AI content creates a dispute, report, rights issue, consent issue, adult-content issue, impersonation concern, payment issue, or policy concern.
Payout holds may apply when a real-person likeness dispute is reported, AI impersonation is suspected, content ownership is unclear, content may be non-consensual, content may violate adult-content limits, content may involve prohibited minor-related content, store products are misleading, fans request refunds due to deception, payment processors require review, or FanSpot determines risk exists.
FanSpot may use creator balances to cover refunds, chargebacks, fees, penalties, disputes, or amounts owed under FanSpot policies.
29. Enforcement
Violations of this Policy may result in warning, required profile edits, required disclosure edits, AI badge addition, content relabeling, content removal, store listing removal, subscription restriction, messaging restriction, discovery suppression, monetization restriction, payout hold, creator tier review, adult-content access revocation if applicable, account suspension, account termination, permanent ban, record preservation, or escalation to appropriate authorities where required or appropriate.
FanSpot may choose the enforcement action based on severity, risk, user history, creator history, intent, cooperation, and platform impact.
30. Appeals
Creators may appeal certain AI policy enforcement decisions.
Appeals should be sent to legal@fanspot.me and include creator username, account email, content or decision being appealed, reason for appeal, supporting documentation, proof of permission if relevant, AI disclosure information if relevant, and any corrective action already taken.
FanSpot may accept, deny, partially grant, or close an appeal.
Some decisions may be final, especially those involving serious impersonation, real-person likeness misuse, non-consensual content, prohibited minor-related content, adult-content violations, fraud, payment risk, or repeated violations.
31. Changes to This Policy
FanSpot may update this Policy at any time.
FanSpot may notify users by posting the updated Policy, updating the “Last Updated” date, sending an email, showing an in-platform notice, or using another reasonable method.
Continued use of FanSpot after this Policy is updated means the user accepts the updated Policy.
