This Policy is part of the FanSpot Terms of Service and Creator Agreement. By accessing FanSpot, creating an account, applying as a creator, uploading content, purchasing content, subscribing to creators, enabling age-restricted access, interacting with age-restricted material, or using FanSpot’s creator tools, you agree to this Policy. 1. Purpose of This Policy FanSpot is a creator monetization platform. FanSpot may support age-restricted creator content only if FanSpot activates those features and only under strict verification, consent, payment, moderation, safety, and compliance rules. The purpose of this Policy is to prevent underage access, prevent underage creator participation, protect consent, protect creators and fans, protect FanSpot’s payment relationships, prevent illegal, exploitative, non-consensual, stolen, or unsafe content, control how age-restricted content appears on the platform, create a clear reporting and takedown process, establish creator obligations for adult-content categories, and keep FanSpot’s general platform separate from age-restricted areas. Age-restricted content is not treated as ordinary platform content. It is subject to higher standards, tighter access controls, stricter creator verification, and stronger moderation. 2. Relationship to Other FanSpot Policies This Policy works together with FanSpot Terms of Service, FanSpot Privacy Policy, FanSpot Creator Agreement, FanSpot Community Guidelines and Content Policy, FanSpot Payments, Payouts, Refunds and Chargebacks Policy, FanSpot Copyright / DMCA / IP Policy, FanSpot AI Creator Policy, and any additional creator verification, consent, payout, or safety rules posted by FanSpot. If this Policy conflicts with a more specific adult-content, payment, verification, consent, or legal rule, the stricter rule applies. 3. Definitions For this Policy: “FanSpot” means FanSpot, operated by Martin Pevec acting as FanSpot. “User” means any person who accesses or uses FanSpot. “Fan” means a user who follows, subscribes to, purchases from, tips, messages, comments on, or interacts with a creator. “Creator” means a user approved or applying to publish content, operate a creator page, offer subscriptions, sell digital products, receive tips, or monetize content through FanSpot. “Age-Restricted Content” means content, pages, posts, products, messages, media, listings, categories, or features that FanSpot determines are only suitable for eligible adults. “Adult Content” means age-restricted creator content that FanSpot classifies as adult-only and subject to this Policy. “Age Gate” means a system, prompt, setting, verification step, or access control intended to prevent ineligible users from accessing age-restricted content. “Adult Creator” means a creator approved by FanSpot to post, sell, or monetize age-restricted content. “Consent Record” means documentation showing that a person appearing in or contributing to applicable content gave valid permission for creation, upload, distribution, promotion, and monetization through FanSpot. “Recordkeeping” means FanSpot’s and/or the creator’s required process for maintaining verification, age, identity, consent, ownership, review, and takedown records. 4. Adult Features Are Not Automatically Active FanSpot may choose to disable, delay, restrict, or remove adult-content features at any time. No user, fan, or creator has a guaranteed right to access, upload, sell, promote, purchase, or monetize adult content. Adult-content access exists only if FanSpot has activated the relevant feature, approved the relevant creator, enabled the relevant user access, and determined that the content, account, payment flow, and verification status meet FanSpot’s requirements. FanSpot may disable adult-content features for legal reasons, safety reasons, payment-processor requirements, verification issues, consent concerns, content moderation concerns, fraud concerns, age-gating concerns, platform trust concerns, or operational limitations. 5. Minimum Age Requirement All users must be at least 18 years old or the age of majority in their jurisdiction, whichever is higher, to access or use FanSpot. Age-restricted content may only be accessed by users who are at least 18 years old, are at least the age of majority in their jurisdiction, are legally allowed to access adult content in their location, have completed any required FanSpot age-access steps, have agreed to all applicable FanSpot policies, and are not restricted, suspended, banned, or otherwise ineligible. FanSpot may deny or revoke access if a user’s age, identity, location, eligibility, payment status, or account status cannot be verified. 6. Age Gate Policy FanSpot may use age gates to prevent ineligible access to age-restricted content. Age gates may include account-level age confirmation, date-of-birth confirmation, warning screens, account setting toggles, age-restricted access settings, identity or age verification, payment eligibility checks, location-based restrictions, manual review, and additional verification required by FanSpot. Users must not bypass, disable, manipulate, misrepresent, or evade FanSpot’s age gates. Users must not help another person bypass FanSpot’s age gates. Users must not allow anyone else to use their account to access age-restricted content. FanSpot may permanently ban users who attempt to bypass age restrictions. 7. Age Verification and Age Access Policy FanSpot may require age verification before allowing access to age-restricted areas. FanSpot may use internal checks, third-party verification providers, payment checks, manual review, account history, or other methods to assess eligibility. FanSpot may require users to provide information such as legal name, date of birth, country or region, government-issued identification, selfie or liveness check, payment eligibility information, account information, or other information needed to confirm eligibility. FanSpot may deny age-restricted access if verification fails, the user appears underage, information is incomplete, information is inconsistent, documents are expired or suspicious, the user refuses required checks, the user is in a restricted location, the account is suspended or under review, or FanSpot determines access creates risk. 8. Fan Access Terms for Age-Restricted Content Fans may access age-restricted content only if FanSpot has approved their access. Fans agree that they will not access age-restricted content while underage, lie about their age, use another person’s account, share their account with another person, show age-restricted content to an ineligible person, download, copy, leak, distribute, resell, reupload, or share paid age-restricted content, request prohibited content from creators, harass, pressure, threaten, exploit, or manipulate creators, use payment disputes or chargebacks abusively, circumvent paywalls, age gates, or content restrictions, attempt to move prohibited activity off FanSpot, or request content involving minors, coercion, non-consent, impersonation, stolen material, or other prohibited categories. FanSpot may restrict, suspend, or ban fan accounts that violate this Policy. 9. Adult Creator Approval Required Creators may not post, sell, promote, message, preview, or monetize adult content unless FanSpot has approved them for adult-content access. A general creator account does not automatically qualify for adult-content monetization. FanSpot may require an adult creator to complete identity verification, age verification, liveness verification, manual review, creator application review, tax setup, payout setup, content category approval, consent record confirmation, ownership confirmation, payment-risk review, and additional checks required by FanSpot. FanSpot may approve a creator for general content but deny adult-content approval. FanSpot may revoke adult creator approval at any time. 10. Adult Creator Verification Policy Adult creators must provide accurate verification information. Adult creator verification may include legal name, date of birth, government-issued ID, selfie or liveness check, country or region, payout information, tax information, account ownership confirmation, duplicate-account review, risk review, manual review, and content-category review. FanSpot may require re-verification if documents expire, account information changes, payout information changes, suspicious activity occurs, reports are submitted, content category changes, FanSpot detects risk, payment partners require additional review, or FanSpot determines re-verification is needed. Failure to complete verification may result in content removal, payout holds, feature restrictions, or account termination. 11. No Adult Content Involving Minors FanSpot has zero tolerance for any content, account, request, message, product, listing, link, promotion, or conduct involving minors in adult, exploitative, suggestive, unsafe, or age-restricted contexts. This prohibition applies to real content, AI-generated content, illustrated content, fictional content, edited content, synthetic content, roleplay content, implied content, youth-coded content, and any content where age cannot be confidently verified when verification is required. Users must not request, upload, create, sell, purchase, trade, describe, promote, link to, or distribute any prohibited minor-related content. FanSpot may immediately remove content, restrict accounts, preserve records, freeze payouts, terminate accounts, and report suspected illegal activity where required or appropriate. 12. Consent Policy All adult content must be lawful, consensual, properly authorized, and compliant with FanSpot rules. Creators are responsible for obtaining valid consent from every person who appears in, contributes to, owns rights in, or is otherwise legally connected to applicable content. Consent must be written, specific, informed, voluntary, current, legally valid, sufficient for creation, sufficient for upload, sufficient for display, sufficient for sale, sufficient for promotion, sufficient for distribution through FanSpot, and sufficient for monetization. Consent to create content does not automatically mean consent to upload, sell, promote, distribute, or monetize that content on FanSpot. FanSpot may require proof of consent at any time. 13. Consent Records Creators must keep accurate consent records for applicable content. FanSpot may require consent records before content is published, after content is reported, during verification review, during payout review, or during any content investigation. Consent records may include full legal name of the person giving consent, confirmation that the person is an adult, confirmation of identity, date of consent, scope of consent, content covered by the consent, permission to upload to FanSpot, permission to monetize through FanSpot, permission to use likeness, image, voice, or performance where applicable, signature or equivalent acceptance, and any supporting documentation requested by FanSpot. If a consent record is missing, unclear, incomplete, disputed, expired, suspicious, revoked, or insufficient, FanSpot may remove content, restrict the creator, hold payouts, cancel sales, refund users, or terminate the account. 14. Content Ownership Requirements Adult creators must own or have all rights required to upload, sell, promote, and monetize content. Creators must not upload stolen content, leaked content, pirated content, content taken from another creator, content copied from another platform without rights, content involving another person without permission, content using another person’s likeness without permission, or content that violates copyright, trademark, privacy, publicity, contractual, or platform rights. FanSpot may require proof of ownership or authorization at any time. 15. Adult Content Recordkeeping Policy FanSpot may require creators to maintain and provide records for adult content. Records may include creator identity verification, creator age verification, participant identity confirmation where applicable, participant age confirmation where applicable, consent records, content ownership records, upload records, takedown records, report records, manual review notes, payout review records, payment dispute records, and compliance records. Creators must keep required records accurate, complete, secure, and available upon request. FanSpot may preserve records when needed for safety, legal compliance, fraud prevention, payment disputes, enforcement, reports, appeals, or platform protection. 16. Adult Content Classification Creators must accurately label adult or age-restricted content. FanSpot may require labels such as age-restricted, mature, adult, AI-generated, synthetic, paid post, subscription-only, store product, custom order, and sensitive or restricted category. Creators must not mislabel adult content as general content. Creators must not use general categories, public previews, usernames, profile text, banners, avatars, thumbnails, captions, tags, or descriptions to bypass age-restricted rules. FanSpot may relabel, hide, restrict, demonetize, or remove mislabeled content. 17. Adult Content Discovery Suppression Rules Age-restricted content must not appear to users who are not approved to access it. FanSpot may suppress age-restricted content from logged-out browsing, public previews, general search, general discovery, homepage recommendations, category browsing, trending sections, suggested creator modules, new creator sections, general ads or public marketing, search engines, and users who have not enabled eligible access. FanSpot may limit or remove adult creator visibility in general platform areas. Adult creators may appear only in adult-enabled discovery areas where FanSpot allows it. FanSpot may reduce, remove, or restrict visibility for adult content at any time. 18. Adult Content Previews FanSpot may restrict adult-content previews, thumbnails, banners, avatars, titles, captions, tags, public descriptions, and promotional material. Creators must not use previews to expose age-restricted material to ineligible users. Creators must not use misleading, explicit, unsafe, prohibited, or non-compliant previews. FanSpot may remove or edit preview availability, hide content, suppress posts, or restrict creator pages that violate preview rules. 19. Adult Content Prohibited Content List FanSpot prohibits adult content that involves or promotes minors or anyone who appears underage, non-consent, coercion, exploitation, trafficking, blackmail, threats, stolen intimate material, leaked intimate material, hidden-camera material, impersonation-based intimate material, real-person AI intimate material without valid consent, content where required consent records are missing, content where required age records are missing, content involving illegal acts, sexual violence or abuse, animals, severe harm, gore, graphic violence, unconscious, incapacitated, or unable-to-consent persons, intoxication where consent is unclear, threats, humiliation, harassment, extortion, private information shared without permission, copyright or ownership violations, payment-processor rule violations, or any content that FanSpot determines creates unacceptable legal, safety, payment, reputational, or operational risk. FanSpot may update this prohibited list at any time. 20. AI and Adult Content AI-generated or synthetic adult content is subject to FanSpot’s AI Creator Policy and this Policy. AI creators must clearly disclose AI status where required. Users must not use AI to create, upload, sell, promote, or distribute adult content using a real person’s likeness without permission, non-consensual intimate content, content involving minors or youth-coded characters, content designed to impersonate a real person, content that misleads fans about whether the persona is real, content that evades verification, consent, ownership, or moderation rules, or content that violates FanSpot’s prohibited content rules. FanSpot may label, restrict, demonetize, remove, or ban AI adult content that violates platform rules. 21. NSFW Creator Agreement Addendum Creators approved for adult-content categories agree that adult creator access is conditional and revocable, adult creators must complete all required verification, maintain accurate consent records, maintain accurate ownership records, label adult content correctly, avoid exposing adult content to ineligible users, avoid misleading previews, reject prohibited custom orders, avoid moving prohibited transactions off platform, cooperate with content reviews, cooperate with consent reviews, cooperate with payment reviews, cooperate with takedown requests, immediately remove or report content that may violate this Policy, and accept that payouts may be delayed, held, reserved, or frozen during adult-content review. Violation of this addendum may result in loss of adult creator access, payout holds, content removal, account suspension, or termination. 22. NSFW Fan Access Terms Fans who access adult-content areas agree that they are eligible adults, they will not lie about age or identity, they will not access adult content in a location where it is illegal, they will not share adult content with anyone else, they will not expose adult content to minors or ineligible persons, they will not request prohibited content, they will not harass or pressure creators, they will not use FanSpot to exploit, threaten, coerce, or manipulate anyone, they will not leak, resell, trade, scrape, download, or redistribute paid content unless expressly allowed, they will not use refunds, chargebacks, or disputes abusively, and they accept that FanSpot may revoke access at any time for safety, legal, payment, verification, or policy reasons. FanSpot may restrict or terminate fan access for violations. 23. Adult Content Moderation Policy FanSpot may review adult content before or after publication. Moderation may be manual, automated, or both. FanSpot may review adult content for age eligibility, creator verification, consent records, ownership rights, correct labeling, prohibited content, payment-processor compliance, AI disclosure, misleading previews, user reports, safety concerns, fraud concerns, legal concerns, and platform-trust concerns. FanSpot may take action including hiding content, removing content, requiring edits, requiring labels, restricting visibility, disabling monetization, holding payouts, pausing subscriptions, restricting creator tools, suspending the creator, terminating the creator, and reporting suspected illegal activity where required or appropriate. 24. Adult Content Reporting Procedure Users may report adult content, accounts, messages, listings, purchases, or creator conduct that they believe violates this Policy. Reports may be sent through FanSpot’s reporting tools or to legal@fanspot.me. A report should include, where possible, the username or creator page, the content URL or location, the reason for the report, a description of the concern, any relevant screenshots or documentation, and whether the issue involves consent, age, impersonation, stolen content, illegal content, harassment, payment abuse, or another concern. FanSpot may prioritize reports based on severity. FanSpot may hide or restrict content during review. 25. Priority Review Categories FanSpot may treat suspected minor involvement, suspected non-consensual content, suspected exploitation, suspected coercion, suspected trafficking, stolen intimate content, impersonation-based adult content, AI adult content involving a real person without permission, missing or disputed consent, missing or disputed age records, illegal content, payment-processor risk, serious harassment or threats, repeat offender activity, or content likely to cause serious harm as high priority. FanSpot may immediately restrict high-priority content or accounts while reviewing the issue. 26. Adult Content Takedown Procedure FanSpot may remove or restrict adult content when the content violates this Policy, the creator fails to provide required records, consent is missing, unclear, disputed, or revoked, age verification is missing, unclear, disputed, or failed, ownership is disputed, the content is reported as stolen, the content violates payment-processor rules, the content is mislabeled, the content was posted by an unapproved creator, or FanSpot determines removal is needed to protect safety, compliance, payment systems, or platform trust. A takedown may result in content removal, temporary content hiding, monetization restriction, store listing removal, subscription pause, creator warning, creator suspension, payout hold, refund review, account termination, record preservation, or escalation to appropriate authorities where required or appropriate. 27. Consent Dispute Process If a person claims that content involving them was uploaded, sold, promoted, or monetized without valid consent, FanSpot may require the creator to provide proof of consent. During review, FanSpot may hide the content, disable purchases, pause subscriptions connected to the content, hold creator payouts, request records, review account history, contact relevant parties, remove content, or terminate creator access if needed. Creators must cooperate promptly. Failure to cooperate may be treated as a policy violation. 28. Ownership Dispute Process If adult content is reported as stolen, copied, leaked, pirated, or uploaded without rights, FanSpot may require proof of ownership or authorization. FanSpot may remove or restrict disputed content during review. Creators who repeatedly upload stolen or unauthorized content may be terminated. 29. Payout Holds for Adult-Content Review FanSpot may hold, delay, reserve, reduce, or freeze creator payouts connected to adult-content review. Payout holds may occur for consent disputes, age disputes, ownership disputes, stolen content claims, illegal content concerns, payment-processor review, chargebacks, refunds, suspicious transactions, creator verification issues, FanSpot policy violations, or recordkeeping failures. FanSpot may use held funds to cover refunds, chargebacks, disputes, processor fees, fraud losses, or other amounts owed under FanSpot policies. 30. Adult Content and Payment Processing Adult-content features are subject to payment-processor, payout-provider, bank, card-network, vendor, and platform-risk rules. FanSpot may restrict adult content even if the content is otherwise lawful, if FanSpot determines that the content creates payment-processing risk. FanSpot may disable adult subscriptions, adult store items, adult tips, adult paid messages, adult custom orders, adult creator payouts, adult creator onboarding, and adult discovery features. FanSpot may change adult-content rules to preserve payment access and platform stability. 31. Adult Content and Subscriptions Adult creators may offer adult-content subscriptions only if FanSpot allows the feature and the creator is approved. Creators must clearly describe subscription benefits without exposing age-restricted material to ineligible users. FanSpot may pause, cancel, restrict, refund, or modify subscriptions if the creator is suspended, the creator loses adult-content approval, content is removed, verification fails, consent records are missing, payment processors require changes, or FanSpot determines there is risk. 32. Adult Content and Store Products Adult digital products may only be listed by approved adult creators if FanSpot allows adult store products. Adult product listings must comply with age-restricted access rules, consent rules, ownership rules, labeling rules, preview restrictions, payment rules, and FanSpot’s prohibited content list. FanSpot may remove adult store products at any time. 33. Adult Content and Custom Orders Adult custom orders or commissions are allowed only if FanSpot activates the feature and approves the creator for that category. Creators must reject any custom request that violates this Policy. Fans must not request prohibited content. FanSpot may review, cancel, refund, restrict, or remove custom orders that create safety, consent, payment, legal, or platform risk. 34. Adult Content and Messaging Adult-content messaging is allowed only if FanSpot activates the feature and approves the relevant accounts. Users must not use messages to request prohibited content, send prohibited content, pressure another user, move prohibited activity off platform, evade age restrictions, evade payment rules, evade moderation, share stolen material, harass, threaten, exploit, or manipulate another person. FanSpot may review, restrict, preserve, or remove messages where needed for safety, moderation, payment disputes, compliance, or enforcement. 35. Public Profile Restrictions for Adult Creators Adult creators must keep public-facing profile areas compliant. FanSpot may restrict adult material from display names, usernames, profile photos, banners, headlines, public bios, public previews, public product thumbnails, public post titles, and public category tags. Adult creators must not use public profile areas to expose age-restricted content to users who have not enabled eligible access. 36. Location-Based Restrictions FanSpot may restrict adult-content access by country, region, province, state, territory, or other location. FanSpot may use user-provided information, IP address, payment information, verification data, or other signals to determine whether access should be allowed. Users must not use VPNs, proxies, false information, or other methods to evade location restrictions. 37. Data Privacy for Age Verification and Consent Records FanSpot may collect and process sensitive information for age verification, identity verification, creator approval, consent review, adult-content moderation, payout review, and legal or payment compliance. Sensitive information may include legal name, date of birth, government ID information, liveness check information, consent records, verification status, payout information, tax information, adult-content review records, and report records. FanSpot will handle this information according to the FanSpot Privacy Policy. FanSpot will not publicly display government IDs, tax IDs, banking information, private consent records, or raw verification documents. 38. Creator Duty to Update Information Adult creators must keep account, verification, consent, tax, banking, category, and content information accurate and updated. Creators must notify FanSpot if consent is withdrawn, a content ownership dispute arises, a person in content disputes publication, a verification document expires, payout information changes, tax information changes, content was uploaded in error, a listing becomes inaccurate, a creator no longer qualifies for adult-content access, or any information previously submitted becomes false, outdated, or incomplete. Failure to update information may result in restrictions or termination. 39. No Off-Platform Evasion Users must not use FanSpot to arrange off-platform activity that violates FanSpot rules. Creators and fans must not move transactions off platform to avoid age verification, consent rules, payment rules, FanSpot fees, moderation, adult-content restrictions, prohibited content rules, reporting systems, takedown systems, or safety controls. FanSpot may take action against accounts that use off-platform activity to evade FanSpot rules. 40. Enforcement Violations of this Policy may result in warning, content removal, content relabeling, reduced visibility, discovery suppression, store listing removal, subscription pause, purchase restriction, messaging restriction, adult-access revocation, adult-creator approval revocation, payout hold, rolling reserve, refund review, chargeback review, temporary suspension, account termination, permanent ban, record preservation, or escalation to appropriate authorities where required or appropriate. FanSpot may choose the enforcement action based on severity, risk, history, intent, cooperation, and platform impact. 41. Repeat Violations FanSpot may permanently remove users or creators who repeatedly violate this Policy. Repeat violations may include repeated mislabeling, repeated missing records, repeated prohibited content attempts, repeated consent issues, repeated age-verification issues, repeated chargebacks connected to adult content, repeated misuse of previews, repeated off-platform evasion, repeated fan harassment, or repeated creator misconduct. FanSpot does not need to follow a three-strike system for serious violations. 42. Emergency Actions FanSpot may take immediate action without prior notice where content or conduct creates urgent risk. Emergency actions may include hiding content, freezing payouts, suspending accounts, disabling purchases, disabling messaging, cancelling subscriptions, preserving records, escalating reports, contacting service providers, or reporting suspected illegal activity where required or appropriate. Emergency action may be taken before a full investigation is complete. 43. Appeals Users and creators may be allowed to appeal certain adult-content enforcement decisions. Appeals should be sent to legal@fanspot.me and include username, account email, content or decision being appealed, reason for appeal, supporting documentation, and any corrective action taken. FanSpot may accept, deny, partially grant, or close an appeal. Some decisions may be final, especially those involving suspected minors, non-consent, exploitation, illegal content, failed verification, missing consent records, payment-processor restrictions, or serious platform risk. 44. Changes to This Policy FanSpot may update this Policy at any time. FanSpot may notify users by posting the updated Policy, updating the “Last Updated” date, sending an email, showing an in-platform notice, or using another reasonable method. Continued use of FanSpot after this Policy is updated means the user accepts the updated Policy. 45.
