This Creator Agreement governs creator accounts, creator applications, creator verification, creator content, monetization tools, storefronts, digital products, commissions, custom orders, creator messaging, creator analytics, creator tiers, payout eligibility, creator compliance duties, creator removals, appeals, and related creator activity on FanSpot.
By applying to become a creator, creating a creator profile, submitting creator information, uploading content, offering subscriptions, listing digital products, accepting tips, selling through FanSpot, using creator tools, receiving payouts, or otherwise acting as a creator on FanSpot, you agree to this Creator Agreement.
This Creator Agreement is part of the FanSpot Terms of Service. If you do not agree to this Creator Agreement, you may not apply as a creator, operate a creator account, monetize content, receive payouts, sell products, offer subscriptions, or use creator tools on FanSpot.
1. Parties
This Creator Agreement is between:
FanSpot, registered government name FanSpot, operated by Martin Pevec acting as FanSpot, and
You, the individual or approved entity applying for or operating a creator account on FanSpot.
For this Agreement, “FanSpot,” “we,” “us,” and “our” mean FanSpot, operated by Martin Pevec acting as FanSpot.
“Creator,” “you,” and “your” mean the person or approved entity applying for, owning, operating, managing, or benefiting from a FanSpot creator account.
2. Relationship to Other FanSpot Policies
This Creator Agreement works together with FanSpot’s other rules and policies, including:
Terms of Service.
Privacy Policy.
Community Guidelines and Content Policy.
AI Creator Policy.
Payments, Payouts, Refunds and Chargebacks Policy.
Copyright / DMCA / IP Policy.
Adult Content, Age Verification and Consent Policy, if applicable.
Creator tier rules.
Store, digital product, commission, and messaging rules.
Any additional creator rules shown during application, verification, posting, selling, or payout setup.
If there is a conflict between this Creator Agreement and a more specific FanSpot creator policy, the more specific policy applies to that issue.
3. Creator Status Is a Privilege
Being a creator on FanSpot is a privilege, not an automatic right.
FanSpot may approve, reject, pause, limit, suspend, remove, or terminate creator access at any time if FanSpot determines that doing so is necessary to protect users, fans, creators, payment systems, legal compliance, platform safety, platform trust, or FanSpot’s business interests.
A user may have a fan account without being approved as a creator.
A creator may be approved for some creator features but not others.
Approval for one feature does not guarantee approval for every feature.
4. Creator Eligibility
To apply for or operate a creator account, you must:
Be at least 18 years old or the age of majority in your jurisdiction, whichever is higher.
Have the legal authority to enter into this Agreement.
Be legally allowed to create, publish, sell, license, and monetize the type of content you submit.
Provide accurate information to FanSpot.
Complete all required verification steps.
Comply with all applicable laws.
Comply with all FanSpot policies.
Own or have valid rights to all content you upload, sell, promote, or monetize.
Maintain accurate payout, tax, banking, identity, and account information.
Avoid conduct that creates fraud, legal, safety, payment, reputational, or operational risk.
FanSpot may require creators to satisfy additional eligibility requirements depending on location, content category, payment method, payout method, risk level, account activity, verification status, or creator tools requested.
5. Creator Application Legal Terms
Submitting a creator application does not guarantee approval.
By submitting a creator application, you confirm that all information provided is accurate, complete, current, and not misleading.
FanSpot may request information including legal name, display name, creator username, email address, date of birth, country or region, creator category, social media links, portfolio links, content plans, monetization plans, store plans, AI creator disclosure if applicable, adult-content category request if applicable and active on FanSpot, identity verification information, tax information, banking or payout information, ownership and consent confirmations, and other information needed to review the application.
FanSpot may approve, deny, delay, or request more information for any creator application.
FanSpot may reject applications based on incomplete information, false information, failed verification, unsupported content categories, high-risk activity, payment-processor restrictions, policy concerns, prior bans, suspicious activity, or platform-fit concerns.
6. Creator Account Stages
FanSpot may use staged creator access.
Creator stages may include:
Basic Creator Applicant: You may apply, create draft profile materials, prepare your page, and submit information, but monetization and public selling may remain locked.
Pre-Verified Creator: You may prepare creator materials, draft posts, build your page, and prepare store listings, but payouts and some monetization tools may remain unavailable.
Verified Creator: You have completed required identity or eligibility checks, but some payout or tax steps may still be pending.
Payout-Eligible Creator: You have completed required payout, banking, tax, and verification steps and may receive payouts subject to FanSpot’s payout policies.
Fully Active Creator: You have completed required checks and are allowed to use approved creator monetization tools, subject to ongoing compliance.
FanSpot may rename, merge, change, or remove creator stages at any time.
7. Creator Self-Certification
By applying as a creator and continuing to use creator features, you certify that:
You are at least 18 years old or the age of majority in your jurisdiction, whichever is higher.
You are the person you claim to be.
You will not provide false or misleading information.
You are legally allowed to monetize content through FanSpot.
You own or control all required rights to your content.
You have all necessary permissions, licenses, releases, and consents.
You will not upload stolen content.
You will not upload content that violates another person’s rights.
You will not upload content involving minors in any prohibited context.
You will not upload illegal, exploitative, abusive, non-consensual, or prohibited content.
You will not mislead fans about content, pricing, delivery, subscriptions, products, identity, AI status, or benefits.
You will follow FanSpot’s payment, payout, refund, chargeback, moderation, safety, and content rules.
You will cooperate with FanSpot during reviews, investigations, disputes, appeals, verification checks, processor reviews, and legal requests.
You understand that FanSpot may remove content, restrict features, freeze payouts, or terminate creator access if you violate this Agreement.
This self-certification applies every time you upload content, create a listing, sell a product, receive a tip, offer a subscription, send a creator message, accept a custom order, or use creator monetization tools.
8. Creator Identity Verification
FanSpot may require identity verification before or after approving creator access.
Verification may include legal name, date of birth, government-issued identification, selfie or liveness check, country or region verification, duplicate-account checks, risk checks, manual review, third-party verification provider review, and any other verification required by FanSpot or payment partners.
FanSpot may restrict creator features if verification is incomplete, failed, suspicious, inconsistent, expired, or refused.
FanSpot may require re-verification at any time.
FanSpot may require creators to update verification information if documents expire, information changes, risk increases, reports are received, payout methods change, or FanSpot determines that additional review is needed.
9. Tax and Banking Requirements
Creators must provide accurate tax and payout information before receiving payouts.
FanSpot may require legal name, tax residency, tax identification number or equivalent, business name if applicable, business classification if applicable, country of residence, payout method, banking or payment-service information, required tax forms, required payout provider onboarding, and any other information needed for payment, tax, reporting, accounting, fraud prevention, or compliance.
Creators are responsible for their own taxes, filings, income reporting, deductions, registrations, remittances, and financial obligations.
FanSpot may withhold, delay, pause, or refuse payouts if tax or banking information is missing, inaccurate, incomplete, suspicious, expired, unsupported, or legally restricted.
FanSpot may report creator payments where required.
10. Payout Eligibility
A creator is not eligible for payouts until FanSpot determines that all required payout conditions are satisfied.
Payout eligibility may require approved creator account, completed identity verification, completed age verification, completed tax setup, completed banking or payout setup, completed manual review, no unresolved high-risk reports, no unresolved fraud concerns, no unresolved consent or ownership disputes, no unresolved payment-processor holds, no disqualifying policy violations, and compliance with all FanSpot policies.
FanSpot may delay, hold, reduce, offset, reserve, or freeze payouts for reasons including refunds, chargebacks, failed payments, payment disputes, suspicious transactions, fraud concerns, fake purchases, self-purchases, coordinated refund schemes, abnormal sales activity, stolen content claims, consent disputes, copyright complaints, identity verification issues, tax information issues, banking issues, adult-content compliance concerns if applicable, AI-content compliance concerns if applicable, account review, legal requests, payment-processor requirements, or any platform-risk concern.
Creators are not entitled to immediate payouts unless FanSpot’s payout policy expressly provides otherwise and all eligibility conditions are met.
11. Creator Revenue Share
FanSpot may pay creators a percentage of eligible net creator earnings based on the creator’s approved tier, feature, product, promotion, or separate written agreement.
Revenue share may vary based on creator tier, product type, subscription type, store sale, tip, paid post, custom order, promotional program, Founding Creator status, processor requirements, refunds, chargebacks, fees, taxes, reserves, deductions, and any special creator program accepted by FanSpot.
Unless FanSpot states otherwise, payment-processing fees, refunds, chargebacks, dispute fees, taxes, reserves, currency conversion fees, bank fees, payout fees, and other third-party costs may be deducted before creator earnings are calculated or paid.
FanSpot may change revenue-share structures, creator tiers, payout methods, fees, and monetization rules by updating the platform, policies, or creator terms.
12. Creator Tier Rules
FanSpot may operate creator tiers such as Bronze, Silver, Platinum, Diamond, or other tiers.
Creator tiers may affect revenue share, upload limits, store features, subscription features, messaging features, analytics access, discovery eligibility, promotional opportunities, payout speed, support priority, badges, early feature access, page customization, and other creator tools.
Creator tier status may depend on sales, followers, active fans, paying fans, account age, posting consistency, refund rate, chargeback rate, compliance history, fan engagement, manual review, trust and safety review, content quality, platform risk, fraud review, and creator conduct.
FanSpot may deny, delay, downgrade, suspend, revoke, or manually review tier status at any time.
Creators must not manipulate tiers through fake purchases, artificial engagement, self-purchases, fake fans, coordinated fan activity, chargeback schemes, refund schemes, bot activity, spam, or other abuse.
Tier benefits are not guaranteed permanently.
13. Creator Content Ownership Declaration
By uploading, posting, listing, selling, messaging, promoting, or monetizing content on FanSpot, you declare that you own the content or have all rights, licenses, permissions, releases, and consents required to use the content on FanSpot.
You are responsible for ensuring that your content does not violate copyright rights, trademark rights, privacy rights, publicity rights, contractual rights, image rights, moral rights, platform policies, applicable laws, or payment-processor rules.
FanSpot may require proof of ownership or permission at any time.
If you cannot provide satisfactory proof, FanSpot may remove the content, restrict your account, hold payouts, cancel sales, refund buyers, terminate creator access, or take other action.
14. Rights Granted to FanSpot
You retain ownership of content you own.
By uploading, posting, listing, selling, messaging, promoting, or otherwise making content available through FanSpot, you grant FanSpot a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, reproduce, display, distribute, transmit, format, adapt for technical purposes, promote, analyze, moderate, review, preserve, and make your content available as needed to operate, improve, protect, enforce, and market FanSpot.
This license allows FanSpot to display your creator page, display posts to authorized users, deliver paid content to purchasers, operate subscriptions, operate store listings, process digital product sales, display previews where permitted, moderate content, review reports, investigate disputes, preserve evidence, process refunds or chargebacks, promote FanSpot or your creator page where permitted, maintain platform backups, and comply with legal, payment, security, and safety obligations.
This license ends when your content is deleted from FanSpot, except FanSpot may retain copies where needed for legal compliance, backups, dispute resolution, chargebacks, fraud prevention, safety investigations, enforcement, tax records, or valid user access to purchased content.
15. Rights Granted to Fans
When a fan purchases, subscribes to, unlocks, or otherwise pays for your content through FanSpot, the fan receives a limited, personal, non-transferable, non-exclusive, revocable right to access that content through FanSpot, subject to FanSpot’s Terms and policies.
Fans do not own your content.
Fans may not redistribute, leak, resell, reupload, copy, publish, scrape, or exploit your content unless you have expressly granted those rights through FanSpot.
FanSpot may remove or restrict fan access where required by law, policy, payment rules, content removal, copyright claims, account termination, or platform risk.
16. Content Accuracy and Creator Promises
Creators must accurately describe content, subscription benefits, store products, custom orders, delivery timelines, pricing, file types, included materials, restrictions, and fan benefits.
Creators must not make false, misleading, deceptive, or unrealistic promises.
Examples of misleading creator conduct include advertising content that is not delivered, listing digital products that do not match the description, promising subscription benefits and knowingly failing to provide them, mislabeling content categories, hiding important restrictions, misrepresenting AI-generated content, misrepresenting identity or affiliation, falsely claiming limited availability, falsely claiming official endorsement, and misrepresenting discounts, bonuses, giveaways, or rewards.
FanSpot may remove misleading listings, require corrections, issue refunds, hold payouts, restrict monetization, or terminate creator access.
17. Creator Store Seller Terms
If FanSpot enables creator storefronts, approved creators may list and sell approved digital products or services through FanSpot.
Creators are responsible for accurate product titles, accurate product descriptions, accurate pricing, accurate file details, accurate delivery terms, proper product categories, required rights and permissions, product quality, product availability, support for purchased products, compliance with FanSpot policies, and compliance with applicable laws.
FanSpot may review, reject, hide, remove, refund, or restrict store listings for any reason, including misleading description, stolen content, copyright concerns, prohibited content, unsafe content, adult-content restrictions if applicable, AI-content disclosure issues, fraud concerns, payment-processor restrictions, poor fan experience, excessive refunds, excessive disputes, and platform-risk concerns.
18. Digital Product Listing Rules
Digital product listings must clearly state what the buyer receives.
A digital product listing should include, where applicable, product title, product description, file type, file quantity, delivery method, delivery timing, usage rights, personal-use or commercial-use restrictions, refund limitations, age restrictions if any and if permitted, AI disclosure if applicable, whether the product is instant delivery or manually fulfilled, whether creator approval is required, and any buyer instructions.
Creators must not list digital products that they do not own or have rights to sell, contain stolen content, infringe intellectual-property rights, mislead buyers, contain malware or harmful files, violate FanSpot content rules, violate payment-processor rules, violate applicable law, require off-platform payment, or create safety, fraud, legal, or platform-trust risk.
FanSpot may require product edits, remove listings, refund buyers, or restrict creator store access.
19. Commission and Custom Order Terms
If FanSpot enables commissions or custom orders, creators may offer approved custom digital work or services through FanSpot.
Creators must clearly state what is included, what is excluded, price, delivery estimate, revision limits, buyer responsibilities, whether approval is required before work begins, whether the commission is digital only, whether files are downloadable, usage rights granted, cancellation rules, refund limitations, and any important content restrictions.
Creators may reject custom-order requests that are unclear, unsafe, prohibited, outside scope, abusive, or not aligned with the creator’s offering.
Creators must reject requests that violate FanSpot policies.
Fans may not request prohibited content.
FanSpot may cancel, restrict, refund, or review custom orders that violate FanSpot policies or create disputes, safety risk, payment risk, or platform risk.
20. Creator Messaging Rules
If FanSpot enables creator messaging, creators must use messaging responsibly.
Creators must not use messaging to harass, threaten, pressure, manipulate, exploit, or abuse fans, request or accept off-platform payment in violation of FanSpot rules, send scams, phishing links, malware, spam, or deceptive offers, mislead fans about paid content or benefits, send prohibited content, request prohibited content from fans, evade moderation, evade age restrictions, evade payment rules, violate privacy rights, share another person’s private information, or encourage rule-breaking.
FanSpot may review, preserve, restrict, or remove messages where needed for support, safety, fraud prevention, payment disputes, moderation, legal compliance, or enforcement.
Creator messaging access may be limited by tier, trust level, verification status, account standing, risk review, or feature availability.
21. Creator Analytics and Data Notice
FanSpot may provide creators with analytics and insights.
Creator analytics may include follower count, subscriber count, paid subscriber count, revenue, store sales, tips, post performance, engagement, conversion rates, fan activity, subscription growth, purchase activity related to the creator, refunds and chargebacks, audience trends, tier performance, and other creator dashboard metrics.
FanSpot may change, limit, delay, remove, or correct analytics at any time.
Analytics are provided for informational purposes only. FanSpot does not guarantee that analytics will be perfect, uninterrupted, complete, or error-free.
Creators must not use analytics to harass, identify, expose, profile, discriminate against, or abuse fans.
FanSpot will not intentionally provide creators with fans’ full payment card numbers, government ID documents, tax identification numbers, private banking details, or raw identity-verification documents.
22. Adult-Content Creator Access
FanSpot may support age-restricted creator categories only if those features are active, permitted by FanSpot, supported by FanSpot’s payment partners, and operated under FanSpot’s adult-content policies.
This Creator Agreement does not give any creator an automatic right to upload, sell, promote, or monetize adult content.
A creator may not post, sell, message, promote, preview, or monetize adult content unless FanSpot has activated that category, the creator is approved by FanSpot for that category, the creator has completed all required verification, all required consent records are complete, all required age checks are complete, all required content labels are applied, the content complies with FanSpot’s Adult Content, Age Verification and Consent Policy, the content complies with payment-processor requirements, the content complies with applicable law, and FanSpot has not restricted or revoked the creator’s access.
FanSpot may deny, suspend, restrict, or revoke adult-content creator access at any time.
FanSpot has zero tolerance for content or conduct involving minors, exploitation, coercion, trafficking, non-consensual material, stolen intimate material, impersonation-based intimate material, or illegal sexual content.
Creators must not upload, request, create, sell, promote, or distribute any content that violates these restrictions.
FanSpot may immediately remove content, freeze payouts, restrict accounts, preserve records, terminate accounts, and report suspected illegal activity where required or appropriate.
23. Consent Obligations
Creators are responsible for obtaining and keeping valid consent for content involving other people.
Where consent is required, creators must ensure that consent is written, specific, informed, voluntary, current, legally valid, and sufficient for creation, upload, sale, promotion, distribution, and monetization through FanSpot.
Consent to create content does not automatically mean consent to post, sell, edit, advertise, distribute, or monetize that content on FanSpot.
FanSpot may require creators to provide consent records, release forms, identity confirmation, age confirmation, ownership proof, or other documentation.
If consent is disputed, unclear, missing, expired, revoked, suspicious, or insufficient, FanSpot may remove content, restrict features, freeze payouts, cancel sales, refund buyers, or terminate creator access.
24. AI Creator Rules
Creators using AI-generated, AI-assisted, synthetic, fictional, or persona-based content must follow FanSpot’s AI Creator Policy.
AI creators must clearly disclose AI status where required.
Creators must not use AI to impersonate real people, mislead fans into believing an AI persona is a real person where that is not true, use another person’s name, image, likeness, voice, identity, or recognizable traits without permission, create non-consensual intimate material involving real people, create prohibited content involving minors or youth-coded characters, evade copyright rules, evade consent rules, evade age-verification rules, evade moderation, or misrepresent AI-generated content as verified real-person content.
FanSpot may label, restrict, remove, demonetize, or ban AI creator content that violates platform rules or creates legal, safety, consent, intellectual-property, payment, or platform-trust risk.
25. Prohibited Creator Conduct
Creators must not upload illegal content, upload stolen content, upload content without required rights, upload content without required consent, upload prohibited adult content, misrepresent identity, age, ownership, AI status, or content rights, use fake fans, fake purchases, fake engagement, bots, or spam, use self-purchases to manipulate revenue, rankings, tiers, or payouts, coordinate refunds, chargebacks, or fake disputes, mislead fans about products, subscriptions, content, pricing, or delivery, harass, threaten, pressure, exploit, or abuse fans, move transactions off platform in violation of FanSpot rules, evade fees, moderation, reporting, verification, or payment controls, violate intellectual-property rights, upload malware, phishing links, harmful files, or deceptive downloads, sell prohibited goods or services, attempt to bypass payout holds or reserves, create accounts to evade enforcement, interfere with FanSpot systems, or create legal, payment, safety, reputational, or operational risk for FanSpot.
FanSpot may determine whether creator conduct violates this Agreement.
26. Prohibited Products and Services
Creators may not list, sell, promote, or deliver products or services that FanSpot prohibits.
Prohibited products and services include illegal goods or services, stolen content, content that infringes intellectual-property rights, fraudulent products, misleading digital files, malware, viruses, phishing tools, or harmful software, products involving non-consensual content, products involving minors in prohibited contexts, products designed to harass, exploit, stalk, dox, threaten, or abuse, products that violate payment-processor rules, products that require off-platform payment in violation of FanSpot rules, and any product or service FanSpot determines creates unacceptable risk.
FanSpot may update prohibited product and service categories at any time.
27. Fan Relationships and Creator Responsibilities
Creators are responsible for maintaining honest, respectful, and safe relationships with fans.
Creators must not exploit fan trust, pressure fans into purchases, make false promises, use manipulative billing language, threaten fans, shame fans for cancelling, retaliate against fans for refunds, reports, or criticism, share private fan information, encourage unsafe conduct, create misleading urgency around purchases, promise personal relationships in exchange for payment, or use creator status to manipulate vulnerable users.
FanSpot may restrict creator activity that harms fans or damages platform trust.
28. Off-Platform Activity
FanSpot may take action based on off-platform activity if that activity affects FanSpot, users, creators, payment systems, safety, legal compliance, or platform trust.
Creators must not use off-platform activity to evade FanSpot fees, evade payment rules, evade age restrictions, evade content rules, harass fans or users, sell prohibited content, coordinate chargebacks or fraud, distribute stolen FanSpot content, threaten or pressure users, or damage FanSpot’s platform integrity.
FanSpot is not responsible for off-platform deals, payments, promises, or disputes unless FanSpot expressly accepts responsibility in writing.
29. Creator Removals
FanSpot may remove or restrict a creator account if FanSpot determines that the creator has violated this Agreement, violated FanSpot policies, failed verification, created risk, or become unsuitable for the platform.
Creator removal may include hiding the creator page, removing content, removing store listings, cancelling subscriptions, restricting messaging, restricting purchases, restricting uploads, removing badges, downgrading tiers, holding payouts, refunding fans, terminating creator status, and banning the account.
FanSpot may remove creators with or without prior notice where necessary.
30. Creator Appeals
Creators may be allowed to appeal certain enforcement decisions.
An appeal should include creator username, account email, the decision being appealed, the reason the creator believes the decision was incorrect, supporting documents or evidence, and any corrective action already taken.
FanSpot may accept, deny, partially grant, or close an appeal.
Some decisions may be final, especially where the issue involves severe safety concerns, fraud, payment abuse, failed verification, adult-content violations, exploitation concerns, illegal activity, repeat violations, or serious platform risk.
Submitting an appeal does not automatically restore content, monetization, payouts, creator status, or account access.
31. Content Review and Moderation
FanSpot may review creator content before or after publication.
Review may be manual, automated, or both.
FanSpot may review content for legal compliance, content policy compliance, payment-processor compliance, copyright issues, consent issues, adult-content restrictions, AI-content disclosure, misleading listings, safety risks, fan reports, fraud concerns, platform quality, discovery eligibility, and creator tier eligibility.
FanSpot may remove, hide, relabel, reduce visibility, demonetize, or restrict content at any time.
32. Refunds, Disputes, and Creator Responsibility
FanSpot may issue refunds, credits, reversals, or adjustments where FanSpot determines appropriate.
Creators may be responsible for refunds, chargebacks, dispute fees, payment reversals, fraud losses, or related costs connected to misleading listings, undelivered digital products, failed custom orders, stolen content, copyright violations, consent issues, policy violations, fraud, unauthorized transactions, creator misconduct, excessive chargebacks, processor decisions, or FanSpot enforcement decisions.
FanSpot may deduct refunds, chargebacks, fees, taxes, penalties, reserves, or amounts owed from creator balances.
33. Chargeback and Fraud Controls
FanSpot may monitor creator accounts for fraud, suspicious activity, abnormal sales patterns, payment abuse, and chargeback risk.
FanSpot may use controls including payout holds, rolling reserves, manual review, sales limits, purchase restrictions, account restrictions, tier review, store restrictions, refund review, delayed payouts, verification checks, feature restrictions, and account termination.
Creators must not participate in chargeback schemes, fake purchases, coordinated disputes, self-purchases, stolen payment activity, refund manipulation, or artificial sales activity.
34. Platform Promotion and Creator Marketing
FanSpot may promote creators, creator pages, posts, public profile materials, store listings, badges, categories, and platform activity through FanSpot discovery, featured sections, homepage areas, social media, emails, ads, investor materials, launch materials, or other marketing channels.
FanSpot may use public creator profile materials for platform promotion unless the creator has a separate written agreement limiting such use.
FanSpot does not guarantee promotion, visibility, search ranking, followers, subscribers, income, sales, or growth.
Creators must not claim FanSpot endorsement, partnership, special status, tier status, or founding status unless FanSpot has approved it.
35. Creator Badges
FanSpot may offer creator badges, including verified badges, tier badges, founding creator badges, AI creator badges, time-on-platform badges, category badges, or other recognition badges.
Badges are platform features and may be granted, changed, hidden, removed, revoked, or redesigned at any time.
A badge does not guarantee income, promotion, verification beyond what the badge specifically represents, or permanent status.
Creators must not misrepresent the meaning of any badge.
36. Creator Support
FanSpot may provide creator support through email, platform tools, help pages, messages, forms, or other channels.
FanSpot may prioritize support based on account type, creator tier, issue severity, safety risk, payment risk, or platform impact.
FanSpot does not guarantee a specific response time unless expressly stated.
Creators must communicate respectfully with FanSpot support.
Abusive, threatening, dishonest, or manipulative support behavior may result in restrictions or termination.
37. Independent Creator Status
Creators are independent users of FanSpot.
This Agreement does not create an employment relationship, partnership, joint venture, agency relationship, franchise, or worker relationship between a creator and FanSpot.
Creators are not employees of FanSpot.
Creators are responsible for their own content, taxes, expenses, equipment, business decisions, pricing, promotion, fan relationships, and legal obligations.
FanSpot provides platform tools and may process payments, but creators remain responsible for their creator activity.
38. No Guarantee of Earnings
FanSpot does not guarantee that creators will earn money, gain followers, receive subscribers, sell products, receive tips, obtain promotion, maintain tier status, or succeed financially.
Creator results depend on many factors including content quality, posting consistency, audience loyalty, pricing, external promotion, fan demand, platform activity, payment success, refunds, chargebacks, compliance, creator conduct, market conditions, and fan engagement.
Creators use FanSpot at their own business risk.
39. Account Security
Creators must protect their accounts.
Creators should use strong passwords and keep login credentials confidential.
Creators must immediately notify FanSpot at legal@fanspot.me if they suspect unauthorized access, account compromise, payout changes they did not authorize, suspicious transactions, or security issues.
Creators are responsible for activity under their accounts unless the activity resulted from FanSpot’s own security failure.
FanSpot may restrict accounts where compromise or suspicious activity is suspected.
40. Confidential and Sensitive Information
Creators may receive access to non-public FanSpot information, including feature previews, creator tools, analytics, policy updates, beta features, payout information, support communications, or internal review details.
Creators must not misuse, leak, sell, publish, or exploit non-public FanSpot information.
Creators must also protect fan information they receive through FanSpot.
Creators must not expose, sell, scrape, export, misuse, or share fan information except as allowed by FanSpot.
41. Privacy and Data Use
FanSpot’s collection and use of creator information is governed by the FanSpot Privacy Policy.
FanSpot may collect and process creator information including account information, application information, verification information, tax information, banking and payout information, creator content, sales information, analytics information, fan interaction information, reports, appeals, support messages, device and security information, and compliance information.
FanSpot may use this information to operate the platform, process payments, review creator eligibility, provide analytics, prevent fraud, enforce policies, comply with legal obligations, and protect platform trust.
42. Intellectual Property Complaints
Creators must respond promptly to intellectual-property complaints involving their content.
FanSpot may remove or restrict content after receiving an intellectual-property complaint.
FanSpot may require creators to provide proof of rights, licenses, permissions, releases, or ownership.
Repeat infringers may be removed from FanSpot.
False ownership claims may result in creator restrictions, payout holds, or termination.
43. Suspension Effects
If FanSpot suspends or restricts a creator account, FanSpot may hide the creator page, remove posts, disable subscriptions, cancel renewals, disable new purchases, disable store listings, disable messaging, disable tips, hold payouts, preserve records, review past transactions, refund fans, request documentation, restrict discovery visibility, prevent new uploads, remove badges, and delay or cancel tier upgrades.
FanSpot may continue to process refunds, disputes, chargebacks, tax records, legal records, and enforcement records after suspension.
44. Termination Effects
If creator status is terminated, creator monetization access may end, creator pages may be hidden or removed, content may be removed or restricted, store listings may be removed, subscriptions may be cancelled, fans may lose access where required by policy, payouts may be held, reduced, offset, or reviewed, FanSpot may preserve records where necessary, the creator may not create another creator account without FanSpot’s permission, and FanSpot may continue enforcing this Agreement.
Termination does not erase obligations that should reasonably survive termination, including payment obligations, tax obligations, refund obligations, chargeback obligations, confidentiality obligations, intellectual-property obligations, indemnity, and enforcement rights.
45. Updates to This Agreement
FanSpot may update this Creator Agreement from time to time.
FanSpot may notify creators by posting an updated version, updating the “Last Updated” date, sending an email, showing an in-platform notice, or using another reasonable method.
Continued use of creator features after an update becomes effective means the creator accepts the updated Agreement.
If a creator does not agree to the updated Agreement, the creator must stop using creator features.
46. Indemnity
You agree to defend, indemnify, and hold harmless FanSpot, Martin Pevec acting as FanSpot, and FanSpot’s contractors, service providers, representatives, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising from your creator activity, your content, your store listings, your digital products, your custom orders, your messages, your violation of this Agreement, your violation of FanSpot policies, your violation of law, your violation of another person’s rights, your failure to obtain required consent, your intellectual-property infringement, your tax obligations, your payout information, your payment disputes, your fraud or suspicious activity, your AI content, your adult-content activity if applicable, your misuse of fan information, or your off-platform activity connected to FanSpot.
FanSpot may control the defense of any claim at your expense where appropriate.
47. Limitation of Liability
To the maximum extent permitted by law, FanSpot, Martin Pevec acting as FanSpot, and FanSpot’s contractors, service providers, representatives, partners, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes damages for lost profits, lost revenue, lost subscribers, lost followers, lost data, lost content, lost business opportunities, store removal, content removal, account suspension, account termination, payout holds, payout delays, refunds, chargebacks, tier downgrades, loss of discovery placement, platform downtime, third-party service failures, and payment-processor decisions.
To the maximum extent permitted by law, FanSpot’s total liability for any claim relating to this Creator Agreement or creator use of FanSpot will not exceed the greater of the amount FanSpot earned from your creator account in platform fees during the three months before the claim arose or $100 CAD.
48. Governing Law
This Creator Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Disputes relating to this Creator Agreement or creator use of FanSpot will be handled in the courts located in Ontario, Canada, unless applicable law requires otherwise or FanSpot chooses another legally available forum.
49. Entire Agreement
This Creator Agreement, together with the FanSpot Terms of Service and all applicable FanSpot policies, forms the entire agreement between you and FanSpot regarding your creator account and creator activity.
